Terms and conditions

These terms apply to every purchase from www.poz-auz.com.au, which is operated by Pozzani Australasia Pty Ltd (ABN 15 690 897 557) of 145 Fitzgerald Road, Laverton North VIC 3026 ("we", "us"). By placing an order you agree to them. Nothing in these terms excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law or any other law that cannot be excluded.

1. Products and descriptions

We take care to describe products accurately, including which appliances a filter fits. Where a product is described as compatible with another manufacturer's appliance, it is not made by that manufacturer, and their trade marks are used only to identify fit. Images are illustrative; packaging may vary. If you are unsure whether a product fits, ask us before ordering.

2. Prices and GST

All prices are in Australian dollars and include GST unless stated otherwise. Delivery charges, if any, are shown before you confirm your order. We may change prices at any time, but changes do not affect an order we have already accepted. If a price is obviously wrong, we may cancel the order and refund you in full before dispatch.

3. Orders and acceptance

Your order is an offer to buy. We accept it when we send the order confirmation email, at which point a contract is formed. We may decline or cancel an order before dispatch, for example where a product is unavailable or a price or description was wrong, and we will refund any payment taken. Trade customers with an account are charged their account price list at the time of ordering.

4. Payment

Payment is taken at checkout by card, Apple Pay or Google Pay through our payment provider, Stripe. We do not store your card details. Trade customers may be offered other terms in writing.

5. Delivery and collection

We deliver within Australia. Delivery times are estimates, not guarantees, and are set out on our Delivery page. Risk in the goods passes to you on delivery to the address you gave, or on collection. Title passes when we receive payment in full. Orders chosen for collection are held at our Laverton North warehouse for [14] days after we tell you they are ready, after which we may cancel the order and refund you.

6. Returns, faults and consumer guarantees

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure. 7. Using filters safely

Install and replace filters as the manufacturer's instructions say and within the stated service life. Water filters sold by us treat mains water that is already microbiologically safe unless a product says otherwise; they are not a substitute for a boil-water notice or for treating unsafe water.

8. Accounts

When you order as a guest we create an account for you so you can track your order, and we email you a temporary password. Keep your password confidential and tell us if you think someone else has used your account. You may ask us to close your account at any time.

9. Our liability

To the extent permitted by law, and other than as provided by the Australian Consumer Law, we are not liable for any indirect or consequential loss arising from your use of the website or the products, and our liability for a breach of a guarantee that can be limited is limited, at our option, to replacing or repairing the goods or paying the cost of doing so.

10. Website and intellectual property

The content of this website, including text, photographs and the Pozzani and FilterLogic names and marks, belongs to us or our licensors and may not be copied without permission. We try to keep the website available and accurate but do not promise that it will be uninterrupted or error-free.

11. Privacy

We handle your personal information in accordance with our Privacy Policy.

12. General

These terms are governed by the laws of Victoria, Australia, and you and we submit to the non-exclusive jurisdiction of the courts of Victoria. If any part of these terms is unenforceable, the rest still applies. We may update these terms from time to time; the version on the website when you order is the one that applies to that order.
